Understanding the Link Between Wrongdoing and Lawsuits
Just because someone does something wrong, incorrect, or negligent, does not make that into a good viable lawsuit. I’m Mike Ashworth, and I’m with TulsaPersonalInjuryLawyer.pro. We’ve said this many times. It’s like baking a cake. Negligence in Oklahoma is defined as duty, breach of that duty, and it causes damages. There’s a link to damages.
Now, there’s a lot of things that could be done wrong, but that doesn’t mean that it’s going to translate into a lawsuit, and more often than not, it comes down to, yes, someone made a mistake, or yes someone did something that was stupid or wrong, but there’s no damages.
For example, what happens if I go to the doctor, doctor prescribes a medication for me, it’s incorrect. It’s not what I’m supposed to be getting, doctor inadvertently does not check my charts, I take a medication for six or seven days, I throw up, I have to go to the ER, Now, those would be damages. But, let’s just say I take care of it myself. I stay home, take care of myself, spend a day or two with atomic ganks, is that gonna be a case that develops into litigation? Probably not.
Understanding Your Cases
That’s one of the most important things about understanding your cases. Do the things, when something bad happens to you, do the things immediately, to show what the impact is on you, your family, your employees, whoever. But for it to be a good litigable case, there has to be some way to quantify, to show in a solid form, damages.
