Understanding Liability and Compensation for Dog Attacks

I’ve spoken a number of times in the past few months about dog attacks and animal attacks. It’s a trend we’re seeing increasingly, increasing dramatically. I thought at first it was because it was summertime when I started doing these videos and therefore there’s just more dogs out and about. I don’t think that’s correct. I think they’re just increasing.

I think they’re increasing because people are not taking care of or properly training their animals and letting them run amok. Sometimes amok, maybe not amok. What they do is they use technology like these electric collars convinced that their dog cannot get out and harm anyone. Well they can.

I had a case today about that very thing where two dogs were on electronic or electric collars and they either ignored the shock or they didn’t care about it and they attacked a woman and tore her up pretty good. There are special rules about animals and if you are in a place you have a right to be and you are attacked, in particular dogs are the most common. I don’t think I’ve seen anything involving any other mammals recently.

Hold the Owner Liable

Then if you did not provoke the dog or the animal that attacked you, the owner can be held liable. However, the most complicating thing, the hardest thing to do to make those cases is not were you attacked? Was it a violation of the law? Should they be held accountable? That’s not the tough part.

The tough part is finding a way to get paid because many, many times when these things happen, the owners of the dogs may not have any kind of insurance or assets to cover that. So if you are attacked, I hate to ask this, but if you’re attacked, if you can do anything you can to identify and link those dogs or animals to a particular address so that down the road there can be a determination made as who is the actual owner and does the actual owner have a method by which you can be compensated for your damages, then we can approach it that way.
