What is a statute of limitations? I’ve done some of these before on this topic and I refer to it as like the shelf life or something at the store. If you look at things at the store best buy or expires on, a statute of limitations is that basically, it expires on. But the difference is you can keep using milk for a few days past the expiration date, butter, meat, and things of that type. The statute of limitations is not quite the same. When the statute of limitations runs the case is essentially over before it started.
I get these calls, like I say, frequently. In the last four days, I’ve had probably six or seven calls where cases and statutes of limitations had run, and some involved highly, highly, highly serious injuries. So my advice is when you go into an attorney you need to ask them, what is my statute of limitations? What does that mean? Be aware though there are different statutes of limitations.
The Importance of Knowing Your Statute of Limitations
Now I do mostly negligence cases. I do cases where there’s a duty, breach of duty, causation, and damages of some kind. The statute of limitations in Oklahoma is two years, but that’s not the end of it. Because the statute of limitations is being measured because you want to sue the government, it’s one year and it’s very complex.
