You know, being my age, I’m in my 60s now, one of the things I really, really give thanks for is that social media did not exist in the first few decades of my life because the damage social media does when you’re just joking around can be incredible.

I cannot tell you the number of times when I did insurance defense, when I worked for the major insurance companies, and even as a prosecutor, I cannot tell you the number of times that I would go online, go to social media about someone that may have been a target of a criminal investigation or may have been suing my insured in an automobile case, and I would find stuff on the internet that just killed their cases. They’re claiming the need for multiple back surgeries, $200,000, oh my gosh, it’s terrible, and then you see their vacation pics. They’re on the top of Mount Baldy yodeling or something like that with a 50-pound backpack.
Social Media in Litigation
Social media is not your friend when you’re involved in possible litigation. It’s not your friend as a defendant. It’s not your friend as a plaintiff. It’s just not, so don’t talk about your cases or your possible cases on the internet. Don’t talk about the fact that, hey, last night I ended up doing fentanyl for a couple hours. Wow, it was great. It reminds me of when I was driving last week. This stuff is insane. It will kill you, so do not use the internet as a means of expressing yourself. If you want to do that, do it on the phone, not via text. Just say, yeah, it’s bothering me a little bit.
