You go to probate court, which is wills, trusts, and estates, and then you may file suit in the district court for personal injury, wrongful death, and things of that type.

It’s important you go to a law firm that knows when you have a case where someone has passed away and at the time of their death they were possessed of a right to bring a suit of some kind that they know to send them to a probate specialist to get appointed as a special administrator, personal representative, executor, something of that type. If a person doesn’t have a will, it doesn’t change things. Then what you do is you have to file a probate in test state. In other words, the person died and they hadn’t made all these arrangements.
